Child Support Issues

The amount of child support is based on income of both parties, parental time share, and any special needs of the children. We ensure that the court has accurate, focusing on actual child-rearing expenses and actual time spent with the child vs. the amount designated in the court order. This includes not only the number of overnight stays, but taking the child to appointments or school, or participating in the child's sports or activities.

If one parent pays support based on 30 percent time share but in reality spends less time with the child, support to custodial parent can be modified upward. Likewise, a parent who is actively involved in the child's life can justify more parenting time and reduction of his or her support obligations.

The Law Offices of Wayne A. McFadden attempts to resolve these issues out of court through negotiation or mediation for approval by a judge. However, we will litigate aggressively on behalf of our clients to ensure their interests are protected.

Fair Treatment in Spousal Support

Spousal support (alimony) is most often awarded for the following circumstances:

  • The higher-earning spouse can maintain the pre-divorce lifestyle while the other spouse cannot
  • One spouse has special needs, such as a physical disability
  • The couple has been married for 10 years or more

Spousal support is typically granted for half the length of the marriage, but it can be awarded permanently (until death or remarriage).

In arguing on behalf of clients for spouse support, we present evidence of income disparity and lesser skills or education, or evidence the other party is hiding assets to downplay ability to contribute alimony.

In challenging spousal support, he may hire vocational experts to assess the ex-spouse's employment skills, work history, and earning capacity. We often can demonstrate that the former spouse could get a better job but chooses not to because he or she prefers a part-time lifestyle.
